REIMBURSEMENT  COVID-19

Two recent events open the way to compensation for fines for violation of anti-pandemic measures - the Office for Personal Data Protection has fined the Ministry of the Interior of the Czech Republic CZK 975,000 for the blanket processing of data on persons who were ordered to be isolated due to proven COVID-19 disease, and a Slovak natural person who was fined for violation of anti-pandemic measures in connection with COVID-19 or paid for a stay in quarantine facilities can claim compensation. This follows from the draft law on compensation of natural persons in connection with anti-pandemic measures, which was approved by the Slovak Government on 6 November 2024.

The Slovak measure, which results from the adopted draft law on compensation of natural persons in connection with anti-pandemic measures, covers the period from 12 March 2020 to 15 September 2023, whereby the beneficiary may request reimbursement of the amount representing the fine imposed or part thereof.

The draft law reflects the ruling of the Constitutional Court of the Slovak Republic as well as the findings of the Ombudsman related to the non-compliance of the state with the legal procedure.
